<p class="wp-block-paragraph">Have you been curious as to how bankruptcy works in Canada? More specifically, how many times you can file bankruptcy? In theory, you can declare bankruptcy as many times as you like in Canada. Practically speaking, however, every time you file the consequences and the difficulty in receiving a discharge from your bankruptcy increases.</p>



<p class="wp-block-paragraph">The length of your bankruptcy and severity of your discharge from bankruptcy is primarily dependent on two items:</p>



<ol class="wp-block-list">
<li>How many times you have been bankrupt in the past; and</li>



<li>Surplus Income, if you have a requirement. (Read more about surplus income requirements)</li>
</ol>



<p class="wp-block-paragraph">These two factors determine the length of your bankruptcy as well as the cost of your bankruptcy.</p>



<p class="wp-block-paragraph">Declaring bankruptcy in Canada is a serious matter and should not be taken lightly. Filing for bankruptcy requires researching how the process works, how to do it, how much it costs and how long it takes. It must also be done with the help of a qualified professional known as a licensed bankruptcy trustee (known as a Licensed Insolvency  Trustee) who will give valuable advice on how best to proceed within the constraints of Canadian law.</p>



<p class="wp-block-paragraph">Any Canadian citizen considering filing personal bankruptcy needs to become informed about these regulations before making any decisions. This article aims to explain exactly how many times one can declare bankruptcy in Canada and the factors that must be considered.</p>



<h2 class="wp-block-heading">Bankruptcy Process Timeline and How It Is Affected By Having A Surplus Income Requirement</h2>



<h3 class="wp-block-heading">1st Bankruptcy</h3>



<p class="wp-block-paragraph">Let&#8217;s discuss what happens if you declare bankruptcy a single time. The first time you declare bankruptcy, if you do not have a surplus income requirement, you are eligible to receive an automatic discharge from your bankruptcy after 9 months. If you have a surplus income requirement, you are eligible to receive an automatic discharge from your bankruptcy after 21 months and you will be required to make payments for 21 months. Provided you fulfill all of your bankruptcy duties, your trustee will issue you a Certificate of Discharge from your bankruptcy at the expiry of the 9 or 21 months.</p>



<p class="wp-block-paragraph">When you declare bankruptcy you should know how your credit will be affected. Your credit will be impacted for a period of 6 years from the date of filing.</p>



<h3 class="wp-block-heading">2nd Bankruptcy</h3>



<p class="wp-block-paragraph">If you have ever wondered &#8216;Can you go bankrupt twice&#8217;, the answer is yes. But if you declare bankruptcy a second time, the process is more complicated.</p>



<p class="wp-block-paragraph">If you do not have a surplus income requirement, you are eligible to receive an automatic discharge from your bankruptcy after after 24 months. If you have a surplus income requirement, you are eligible to receive an automatic discharge from your bankruptcy after 36 months and you will be required to make payments for 36 months. Provided you fulfill all of your bankruptcy duties, your trustee will issue you a Certificate of Discharge from your bankruptcy at the expiry of the 24 or 36 months.</p>



<p class="wp-block-paragraph">Second bankruptcies in Canada are far more damaging than first-time bankruptcies as it relates to credit. Your credit will be impacted for a period of 14 years from the date of filing.</p>



<h3 class="wp-block-heading">3rd+ Bankruptcy</h3>



<p class="wp-block-paragraph">If you declare bankruptcy a third time or more, the process is even more complicated. You will be required to make payments for a longer period of time, as determined by the Court. You will not be eligible for an automatic discharge.</p>



<h3 class="wp-block-heading">Conclusion</h3>



<p class="wp-block-paragraph">As you can see, the process and the consequences of declaring bankruptcy in Canada become more severe each time it is done. It is important to note that regardless of whether it is your 1st bankruptcy, or your 2nd if you do not follow the rules and requirements of your bankruptcy, you may not be eligible for an automatic discharge which can have unpredictable consequences as you will be required to attend Court in front of the Bankruptcy Registrar who may impose additional duties. And before you ask, no &#8211; there is no worse impact to your <a href="https://maritimetrustee.ca/blog/faq/will-i-lose-my-house-if-i-go-bankrupt/" data-type="URL" data-id="https://maritimetrustee.ca/blog/faq/will-i-lose-my-house-if-i-go-bankrupt/">house</a> based upon how many times you have filed bankruptcy.</p>



<h2 class="wp-block-heading">Wisdom From a Licensed Insolvency Trustee: Don&#8217;t File Bankruptcy More Than Twice If You Can Help It. There are other options.</h2>

<p class="wp-block-paragraph">While you are allowed to declare bankruptcy as many times as you like in Canada, that doesn&#8217;t mean it&#8217;s a good idea to do so. In fact, as a <a href="https://maritimetrustee.ca/blog/what-is-a-licensed-insolvency-trustee-trustee-in-bankruptcy/" data-type="URL" data-id="https://maritimetrustee.ca/blog/what-is-a-licensed-insolvency-trustee-trustee-in-bankruptcy/">Licensed Insolvency Trustee</a>, we generally do not recommend people file bankruptcy more than two times unless the circumstances require it.</p>



<p class="wp-block-paragraph">As indicated above, if you file more than twice you are not eligible for an automatic discharge from your bankruptcy. This means you have to appear in Bankruptcy Court for an application to obtain your discharge. You will likely be required to answer questions and the Registrar will make a decision as it relates to your discharge. Even if you have fulfilled all of your obligations as outlined by the Bankruptcy and Insolvency Act prior to the Court discharge hearing, it does not mean you will necessarily get a favourable outcome. The Bankruptcy Registrar has significant leeway regarding the outcome of a bankruptcy discharge.</p>



<h2 class="wp-block-heading">How to avoid a third bankruptcy?</h2>



<p class="wp-block-paragraph">There are several bankruptcy alternatives. A consumer proposal is often a good alternative to claiming bankruptcy in Canada if you have already been bankrupt twice in the past. A consumer proposal is a debt settlement agreement between you and your creditors that allows you to repay a portion of your debts, over a period of time, and avoid declaring bankruptcy.</p>

<p class="" style="white-space: pre-wrap;">First-time bankrupts with no surplus income requirement will automatically receive a discharge after 9 months or after 21 months if they have <a href="https://maritimetrustee.ca/blog/what-is-surplus-income-and-how-will-it-affect-my-bankruptcy/">surplus income</a>.</p>
<p class="" style="white-space: pre-wrap;">Second-time bankrupts will receive an automatic discharge after 24 months, or 36 months if they have surplus income;</p>

They gather their information from lenders, collection agencies and public records. Members include banks, finance companies, auto leasing companies, credit card companies and retailers.</p>
<p class="" style="white-space: pre-wrap;">If you are already behind on payments to your creditors or are in collections, this is most likely already reflected on your credit rating.</p>

This information is available to credit grantors and may affect your ability to get credit in the future.</p>

<p class="wp-block-paragraph">Hiding from the reality of your financial situation will do nothing to improve it. People have a predisposition to hide from the truth, especially when the truth is ugly. Unfortunately, we see this every day.</p>



<p class="wp-block-paragraph">People come into our office, and we go through their situation. <p class="wp-block-paragraph">In many cases, it is clear that a dire financial situation has existed for quite some time. If the situation had been identified and addressed earlier our services may not have been needed. This is not the case for everyone that we meet, however.</p>

<p class="wp-block-paragraph">We live in a credit culture bombarded with easy credit and never-ending ways to use that credit to satisfy today&#8217;s wants and needs without thinking about the cost. This, combined with poor financial literacy, leads many to build a mountain of debt, which is impossible to climb.</p>



<p class="wp-block-paragraph">The most obvious way people avoid looking at the reality of their situation is by not sitting down, putting everything on paper and seeing where they are. Make a list of all sources of income, monthly living expenses, and your debts and monthly payments. How do your expenses compare to your monthly income? Do you know where your money is going every week, month, year?</p>

<p class="" style="white-space:pre-wrap;">On December 2, 2015, the Office of the Superintendent of Bankruptcy Canada released <a href="https://www.ic.gc.ca/eic/site/bsf-osb.nsf/eng/br03476.html">Directive 33, <em>Trustee Designation and Advertising</em></a>, updating the designation to be used by Licensed Trustees with regards to the advertisement, promotion,&nbsp;and communications related to their services.&nbsp; All trustees holding a valid license will now adopt the professional designation “<a href="https://maritimetrustee.ca/blog/why-choose-a-licensed-insolvency-trustee/"><strong>Licensed Insolvency Trustee</strong></a>”, which replaces the previous designation of “Licensed Trustee in Bankruptcy”.</p>
<p class="" style="white-space:pre-wrap;">The updated designation is welcome news for insolvency professionals as it better captures the broad range of services and level of expertise we offer to our consumer and corporate clients.&nbsp; Consumers often think that we only provide bankruptcy services and there is a negative connotation to the &#8220;bankruptcy&#8221; word that can lead consumers to seek out other options, such as unlicensed and unregulated <a href="https://maritimetrustee.ca/blog/consumer-proposal-debt-management-or-debt-settlement-which-is-right-for-me/"><strong>debt settlement </strong></a>firms and for-profit <a href="https://maritimetrustee.ca/blog/consumer-proposal-vs-credit-counselling/"><strong>credit counselling</strong></a> agencies.&nbsp; When that happens, the consumer does not always receive the professional advice and expertise they would otherwise receive if they had reached out to a Licensed Insolvency Trustee.</p>

<p class="" style="white-space:pre-wrap;">Bankruptcy is not the only debt solution option available to resolve overwhelming debt. Your Trustee (Licensed Insolvency Trustee) can also put together a settlement proposal to your creditors. Where you pay a portion of the debt, you owe your creditors, and the creditors write off the remaining balance of the debt. This process is known as a&nbsp;<a href="https://maritimetrustee.ca/blog/consumerproposal/" target="_blank" rel="noopener">consumer proposal,&nbsp;</a>and it provides you with the same legal protections as a <a href="https://maritimetrustee.ca/blog/personal-bankruptcy/">personal&nbsp;bankruptcy</a>.</p>
<p class="" style="white-space:pre-wrap;">If the majority of your creditors agree with the consumer proposal, the consumer proposal is binding on all creditors. Even creditors that did not agree with the consumer proposal.</p>
<p class="" style="white-space:pre-wrap;">A consumer proposal can provide for a fixed monthly payment, which will not increase if your income goes up. A consumer proposal can allow you to maintain control over your assets. Such as your house, vehicles, <a href="https://maritimetrustee.ca/blog/what-happens-to-my-rrsps-and-other-investments-in-bankruptcy-or-a-consumer-proposal/">RESPs</a>, and&nbsp;<a href="https://maritimetrustee.ca/blog/what-happens-to-my-rrsps-and-other-investments-in-bankruptcy-or-a-consumer-proposal/" target="_blank" rel="noopener">RRSPs,&nbsp;</a>and you get to keep your income tax refunds.&nbsp;&nbsp;</p>

To Bank or finance companies for equipment or <a href="https://maritimetrustee.ca/blog/buying-vs-leasing-a-new-vehicle-part-two-the-risks-and-benefits-of-leasing/">vehicle financing or leases</a> and some suppliers may require personal guarantees.</p>

<p class="" style="white-space:pre-wrap;"><strong>Director Liabilities &#8211; </strong>If you are a director of a corporation, you may be liable for certain debts.  The most common debts that fall into this category are; unremitted payroll deductions and HST, and the penalties and interest.  Also, directors are generally liable for environmental damages caused by the Company.  Corporate income taxes are not a personal <a href="https://maritimetrustee.ca/director-obligations/">obligation of the directors</a>.</p>

<p class="" style="white-space:pre-wrap;">Yes, you can declare personal bankruptcy a second time, as long as you have been discharged from your first bankruptcy and meet the following criteria.</p>
<ul data-rte-list="default">
<li>
<p class="" style="white-space:pre-wrap;">you are unable to pay your debts as they become due;</p>
</li>
<li>
<p class="" style="white-space:pre-wrap;">you have ceased making your payments as they generally come due; or</p>
</li>
<li>
<p class="" style="white-space:pre-wrap;">your assets, if liquidated, would not provide sufficient funds to pay all of your debts in full.</p>
</li>
</ul>
<p class="" style="white-space:pre-wrap;">If you don&#8217;t have <a href="https://maritimetrustee.ca/blog/what-is-surplus-income-and-how-will-it-affect-my-bankruptcy/" target="_blank" rel="noopener"><strong>surplus income</strong></a>, comply with your duties and cooperate with your trustee on other estate matters.  You are eligible to be discharged from your second bankruptcy, after 24 months.</p>
<p class="" style="white-space:pre-wrap;">The following are some of the duties of a bankrupt:</p>

<p class="" style="white-space:pre-wrap;">Complete two mandatory financial counselling sessions with a Licensed Insolvency Trustee office;</p>
</li>
<li>
<p class="" style="white-space:pre-wrap;">Report your monthly take-home income to your Licensed Insolvency Trustee office for at least 22 months.</p>
</li>
</ul>
<p class="" style="white-space:pre-wrap;">If you have surplus income, you will be eligible for discharge after 36 months or when all your required surplus income payments have been paid.</p>
<p class="" style="white-space:pre-wrap;">A second bankruptcy will be recorded on your credit report for 14 years.&nbsp;&nbsp;</p>
<p class="" style="white-space:pre-wrap;">If this is your second time experiencing financial difficulty, you should consider filing a&nbsp;<a href="https://maritimetrustee.ca/blog/consumerproposal/" target="_blank" rel="noopener"><strong><em>consumer proposal</em></strong></a>&nbsp;rather than a second bankruptcy.&nbsp;<em>&nbsp;</em>The consumer proposal will only be recorded on your credit report three years after the consumer proposal is completed.</p>

<p class="" style="white-space: pre-wrap;">Trustees are professionals who are licensed and regulated by the federal government under the Bankruptcy and Insolvency Act (&#8220;<strong>BIA</strong>&#8220;). Most Trustees are also members of the <a href="https://cairp.ca/">Canadian Association of Insolvency and Restructuring Professionals (&#8220;<strong>CAIRP</strong>&#8220;)</a>, a national organization. Trustees must follow professional ethics and code of conduct rules and guidelines set out in the BIA and issued by CAIRP.</p>

<p class="" style="white-space: pre-wrap;">Your Trustee&#8217;s job is to administer your bankruptcy or consumer proposal following the Bankruptcy and Insolvency Act.</p>
